Website terms of use

Last updated:

These terms are an agreement between you and PA’ COMER BAKERY AND SUBS INC, doing business as PA’ COMER CUBAN PIZZA (“Pa’ Comer”, “we”), a Florida corporation with its address at 353 W 23rd St, Hialeah, FL 33010.

By using this site you accept these terms. If you do not agree with them, please do not use it.

Summary of key points

  • This site is for browsing our menu, finding our shops and placing orders. There are no user accounts and no subscriptions.
  • The brand and the photos are ours: they cannot be used commercially without permission.
  • The price that applies is the one shown when you order, not one from a cached page.
  • Ordering terms, refunds and allergens have their own pages, and they form part of these terms.
  • Florida law applies, and the courts of Miami-Dade County.

1. Our service

This site lets you browse the menu, find our shops and their hours, and place an order for pickup or dine-in. We do not offer user accounts, subscriptions or a mobile app.

The site is intended for people in the United States. We make no promise that its content is appropriate or available elsewhere.

2. Intellectual property

PA’ COMER is a registered trademark of PA’ COMER BAKERY AND SUBS INC. The name, the logo, the texts, the photographs of our dishes and shops and the design of this site belong to the business or are used under licence.

You may view the content, share a link and save or print a page for personal use. You may not reproduce it commercially, resell it, modify it or scrape it automatically without written permission.

3. What you confirm by using the site

By using this site you confirm that:

  • The information you give us is true and current.
  • You are not a minor, or you have your parent or guardian’s permission.
  • You will not use the site for any unlawful or unauthorised purpose.
  • Your use of the site does not breach any applicable law.

4. Prohibited uses

You may not use this site to:

  • Systematically or automatically extract data to build a database or a competing service.
  • Mislead other people or impersonate the business or its staff.
  • Try to reach non-public parts of the site or its systems.
  • Introduce viruses, malicious code or anything that interferes with how it works.
  • Make automated use that overloads the service.
  • Harass, threaten or abuse our staff.

5. Prices, dishes and availability

The menu, prices and offers may change without notice. We take care to keep the site current, but the price that applies is always the one shown when you place your order.

Photographs are illustrative: a dish may be plated differently. Availability depends on the location and the moment.

We reserve the right to correct an obvious pricing or description error, and to cancel an affected order by telling you and refunding you.

6. Orders and payment

The specific conditions of an online order — what is charged, the timings, the offers — are on the ordering terms page. Refunds and cancellations are on theirs. Both form part of these terms.

7. Allergens and food safety

Allergen information is on its own page and you should read it before ordering if you have an allergy or an intolerance. We work in a shared kitchen and cannot guarantee the absence of any allergen.

8. Third-party links and services

We link to Uber Eats, DoorDash, Google Maps, Clover and our social profiles. Those services are not ours: they have their own terms and privacy policies, and we are not responsible for their content, prices or performance.

When you order through a delivery app, the delivery contract is with the app, not with us.

9. Site availability

We do our best to keep the site up, but there may be interruptions for maintenance, technical faults or causes outside our control. We do not guarantee uninterrupted availability and are not liable for a loss arising from the site being unavailable at a given moment.

10. Disclaimer of warranties

The site and its content are provided “as is” and “as available”. To the extent permitted by law, we make no warranties of any kind as to their accuracy, completeness or fitness for a particular purpose.

11. Limitation of liability

To the extent permitted by law, we will not be liable for indirect, incidental or consequential damages arising from use of the site. Our total liability in relation to an order is limited to the amount you paid for that order.

None of this limits the rights the law gives you as a consumer, nor our responsibilities on food safety.

12. Governing law and disputes

These terms are governed by the laws of the State of Florida, without regard to its conflict of law rules.

Any dispute relating to this site or to an order will be resolved before the competent courts of Miami-Dade County, Florida, to whose jurisdiction both parties submit.

Before going to court, we ask you to write to us: the vast majority of things get sorted out with a phone call.

13. Changes to these terms

We may change these terms at any time. The date at the top shows the last revision, and the version in force is always the one published on this page.
